This is an agreement between you and Amazon.com Services LLC (with its affiliates, "Amazon," "we," "us," or "our"). Before using Bee, please read these Bee Terms of Use, the Amazon.com Privacy Notice, the Amazon.com Conditions of Use, the Amazon Device Terms of Use, the Alexa and Amazon Devices Acceptable Use Policy, and the other applicable rules, policies, and terms posted on the Amazon.com and bee.computer websites, available through your Bee App, or provided with Bee Enabled Products (collectively, this "Agreement"). By using Bee, you agree to the terms of this Agreement on behalf of yourself and all other persons who use Bee under your account. If you do not accept the terms of this Agreement, then you may not use Bee.
For the purpose of these Bee Terms of Use:
"Bee" means Amazon's Bee services, which include Connected Services, digital content, Software, the Bee App, and support and other related services.
"Bee App" means the app or website provided by Amazon that provides access to Bee, Bee's settings, Bee-related content, and other information.
"Bee Interaction Data" means: (a) transcripts of audio captured by your Bee Enabled Product; (b) summaries and related data generated from those transcripts; and (c) acoustic models generated when you create a voice profile or assign a name to a speaker in your transcripts. By default, Bee Interaction Data is processed and stored only within the Private Compute Environment.
"Bee Enabled Product" means any product, service, or application that enables access to Bee, such as the Bee Pioneer devices and the Bee App.
"Bee Service Data" means information that Amazon collects and processes outside of the Private Compute Environment to operate, maintain, and improve Bee, such as account information, device identifiers, usage metrics, and technical logs. Bee Service Data does not include your Bee Interaction Data.
"Connected Service" means any service or application, including Amazon services such as Alexa, that we make available to you for use on or through Bee.
"Private Compute Environment" means the environment used to process and store your Bee Interaction Data. The Private Compute Environment is designed so that only you (and not Amazon) can access your Bee Interaction Data.
"Software" means all software that we make available to you for use in connection with Bee.
1.1 Bee. A Bee Enabled Product and internet connection are required to access and use Bee. Some Bee services may not be available in all areas or on all Bee Enabled Products and may require separate fees or subscriptions.
1.2 Use of Bee and the Software. Your use of Bee must comply with the Alexa and Amazon Devices Acceptable Use Policy. You may use the Software only on or through a Bee Enabled Product. For additional terms that apply to the Software, see the software terms contained in the Amazon.com Conditions of Use. You may only use Bee for personal use.
1.3 Bee Interaction Data. Bee uses a Private Compute Environment to process audio and to generate and store Bee Interaction Data. Audio is automatically deleted after it is processed. While in the Private Compute Environment, only you have access to your Bee Interaction Data. If you do not want certain information processed by Bee, do not share it with Bee.
1.4 Connected Services. If you choose to send your Bee Interaction Data to a Connected Service, that data leaves the Private Compute Environment and is processed in accordance with the applicable terms and privacy notices for that service. If you choose to use a Connected Service provided by Amazon, the Amazon.com Privacy Notice and applicable terms will apply to any data you send to Amazon. If you do not accept a Connected Service's terms, do not use that Connected Service. Amazon has no responsibility or liability for any third party Connected Service. Providers of Connected Services may change or discontinue the functionality or features of their Connected Service. You may disconnect any Connected Service at any time through the Bee App. When you disconnect, Bee will stop sharing your Bee Interaction Data with that service. Data previously shared with the Connected Service may be retained by that service in accordance with its own terms and policies. Amazon cannot delete or recall data that has been transmitted to a Connected Service.
2.1 Recording Consent and Compliance. You are responsible for complying with all applicable laws regarding the use of your Bee Enabled Products. Some jurisdictions require obtaining consent to record communications. You represent and warrant that you have obtained all necessary consents and authorizations for any communications you record with a Bee Enabled Product. You may not disable, obscure, obstruct, or otherwise tamper with any indicator on a Bee Enabled Product in any way, including to prevent a recording indicator from being visible to others.
2.2 Voice Profiles. You can create a voice profile so Bee can recognize you when you speak to your Bee Enabled Products. When you create a voice profile, recordings of your voice are used to create an acoustic model of your voice characteristics. You may also choose to identify other speakers in your transcripts by assigning a name to a speaker. When you do so, an acoustic model of that individual's voice characteristics will be created if enough data is available. These acoustic models, which may be considered biometric data in some locations, are Bee Interaction Data and are stored within the Private Compute Environment. If your use of Bee is subject to legal requirements related to the collection, possession, processing, use, disclosure, storage, or deletion of any biometric information or identifiers, including without limitation requirements under the Illinois Biometric Information Privacy Act (BIPA), the Texas Capture or Use of Biometric Identifier Act (CUBI), the Washington Biometric Identifier statute, the California Consumer Privacy Act, or any other laws governing biometric data, then you must comply with all such legal requirements. This includes providing legally adequate notices to all relevant data subjects, obtaining any necessary consents, and deleting biometric identifiers and information when required.
3.1 Age. Bee is intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use Bee.
3.2 Information. Amazon processes Bee Service Data to operate, maintain, and improve Bee, provide customer support, and communicate with you about your account. This information is collected and processed outside the Private Compute Environment and is not Bee Interaction Data. Bee Service Data is processed in accordance with the Amazon.com Privacy Notice.
3.3 Functionality; Content. Bee uses AI to generate transcripts, summaries, and other content and to take certain actions. Bee may get things wrong, including by failing to take a requested action or taking an action different from what you requested. Bee's outputs may be inaccurate, incomplete, and not representative of Amazon's views. Amazon has no responsibility or liability for such content.
3.4 Changes to Bee; Amendments. We may change, suspend, or discontinue Bee, or any part of it, including any Connected Services, at any time without notice. We may amend any of this Agreement's terms at our sole discretion by posting the revised terms on the Amazon.com website. Your continued use of Bee after the effective date of the revised Agreement constitutes your acceptance of the terms.
3.5 Termination. We may terminate access to Bee at our discretion without notice (except as may be required by applicable law). Your rights under this Agreement will automatically terminate without notice if you fail to comply with any of its terms. Upon termination, Amazon may immediately revoke your access to Bee without refund of any fees. Amazon's failure to enforce strict compliance with this Agreement will not constitute a waiver of any of its rights.
3.6 Disputes. Any dispute or claim arising from or relating to this Agreement or Bee is subject to the dispute resolution, governing law, disclaimer of warranties, limitation of liability, and all other terms in the Amazon.com Conditions of Use.
3.7 Disclaimer of Warranties and Limitation of Liability. Without limiting the Disclaimer of Warranties and Limitation of Liability terms in the Amazon.com Conditions of Use, and unless otherwise required by applicable law, in no event will our or our licensors' or our service providers' aggregate liability with respect to any claim arising from or relating to this Agreement or your use of Bee exceed fifty dollars ($50).
3.8 Indemnification. You're responsible for your use of Bee. You agree to indemnify Amazon and its affiliates for all claims, demands, actions, suits, damages, liabilities, losses, settlements, judgements, costs, and expenses, including but not limited to reasonable attorneys' fees and costs, arising out of or related to your use of Bee in any way that violates applicable law or this Agreement.
3.9 Severability. If any term or condition of this Agreement is deemed invalid, void, or for any reason unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining term or condition.
